In this paper, it will be analyzed the topic of the original acquisition of property rights. First of all, it should be said that the original acquisition of property rights belongs to the acquisition on the basis of law. In the case of the original acquisition, it should be pointed out that the acquirer does not base the right of ownership on the right of ownership of the ancestor. This would mean that the original acquisition of ownership occurs regardless of whose property it is and regardless of whether there is a right to the property in favor of a third party. Ownership is acquired originally when the preconditions set by law are met. The methods of the original acquisition of property rights include tenure, acquisition from non-owners, appropriation, finding of property and acquisition of accruals. For each of these methods, the most important features will be highlighted, as well as the assumptions that need to be met in order for ownership to be acquired in a certain way. The introductory part of the paper will also mention the institute of ownership, which is also the most important institute of real law, and is the fundamental institute of every legal system. The methods used in writing this paper are: classification method, historical method and induction and deduction methods.
